Terms of Use
These Terms of Use ("Terms") apply to Daily Diversion, a mobile puzzle app provided by NayDew LLC ("NayDew," "we," or "us"), a Minnesota limited liability company. Please read them before using the app. These Terms supplement applicable app-store terms and do not take away any non-waivable consumer rights.
1. What Daily Diversion provides
Daily Diversion offers a growing collection of daily games and challenges. The app is offered for entertainment. Daily content, rules, availability, features, and supported platforms may change over time. Daily puzzle selection may depend on your device's date.
2. Who may use the app
Daily Diversion is a general-audience app and is not specifically directed at children under 13. If you are a minor, use the app with any parent or guardian permission required by applicable law. You must use the app in compliance with laws that apply where you live.
3. License and app-store terms
Subject to these Terms and applicable law, NayDew grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your own noncommercial entertainment. The app and its content are licensed, not sold. You may not copy, sell, redistribute, reverse engineer, or exploit the app except where law permits it.
If you download Daily Diversion from Apple's App Store, Apple's standard Licensed Application End User License Agreement applies to the license unless a valid custom agreement is supplied in App Store Connect. If any mandatory app-store term conflicts with these Terms, that mandatory term controls.
4. Accounts, progress, and daily puzzles
No account or subscription is required to play. Gameplay history, streaks, and statistics are stored locally on the device. They may be lost if you uninstall the app, erase app data, replace a device without a suitable backup, or encounter a technical failure. NayDew does not maintain an account-based backup of this progress. We do not guarantee that a particular streak, statistic, or daily puzzle will remain available indefinitely.
5. Optional rewarded advertising
The app may offer a chance to watch a Google AdMob rewarded advertisement for optional hints or, in Sudoku, a continuation. Availability varies with the device, network, location, and applicable privacy preferences. An optional reward is granted only when the app receives the required successful ad-reward event, subject to its game rules. An advertisement may sometimes fail to load or be unavailable; no ad reward is guaranteed. You can continue to use the normal puzzle gameplay without choosing personalized advertising or granting tracking permission.

6. Acceptable use
Please do not unlawfully interfere with the app, exploit security flaws to disrupt other systems, distribute malware, infringe another party's rights, or misuse advertising features. This provision does not restrict rights that applicable law expressly protects, including lawful security research or legally permitted interoperability.
7. Intellectual property
Daily Diversion, NayDew branding, app design, and original puzzle content are owned by NayDew or its respective licensors. All rights not expressly granted are reserved. No right to use NayDew's names, logos, artwork, or puzzle databases for commercial purposes is granted by these Terms.
8. Availability and changes
We may maintain, update, alter, suspend, or discontinue features or content as reasonably necessary. We strive to provide a working app but cannot promise uninterrupted availability, error-free puzzles, or compatibility with every device. We may update these Terms and will make the revised version available with an updated effective date and additional notice where required.
9. Warranties and responsibility
To the extent permitted by applicable law, the app is offered on an "as is" and "as available" basis without additional warranties. To the extent permitted by law, NayDew is not responsible for indirect or consequential losses arising from use or unavailability of the app. Nothing in these Terms limits liability or remedies that cannot legally be excluded, including consumer guarantees or other mandatory protections in your country. These Terms do not exclude liability for fraud, willful misconduct, or other liability where exclusion is prohibited.
10. Governing law
Except where mandatory local consumer-protection law provides otherwise, these Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict-of-laws principles. Nothing here deprives users outside Minnesota of mandatory rights available in their home jurisdiction. Any court or venue provisions must comply with those mandatory rights.
